This page (together with the documents referred to on it) tells you the terms by which you may use our website www.learnmonade.com.

Please read these terms of use carefully before you start to use the site.

By using our site, you indicate that you accept these terms of use and that you agree to abide by them.

If you do not agree to these terms of use, please refrain from using our site. 

I. Information about us 

www.learnmonade.com is a site operated by Learnmonade Limited (“we”, “us” or “our”). We are a limited company registered in Hong Kong and have our registered office at Mong Kok, Shantung Street, 47-51 Chung Kiu Commercial Building, 22nd Floor, 2201. 

II. Other terms 

There are other terms that apply to your use of our site, as follows: 

  • Our Privacy Policy; and 
  • Our Cookies Policy. 

In addition, if you purchase services from us that are delivered using our site, the terms of our services contract with you will apply to the provision of such services.

III. Accessing our site 

Access to the site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period. 

 

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms and that they comply with them. 

IV. Intellectual property rights 

We are the owner or the licensee of all intellectual property rights in and to our site, and in and to the material published on it (including our Mini-Courses). Those works are protected by copyright laws and treaties around the world. All such rights are reserved. 

 

You must not modify any paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences, or any graphics separately from any accompanying text. 

 

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged. 

You must not use any part of the materials on our site for commercial purposes without obtaining a license to do so from us or our licensors. 

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. 

 

For the avoidance of doubt, you may not sell any of the Mini-Courses or any of the information set out on our site. 

V. Reliance on information posted 

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We, therefore, disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents. 

VI. Our sites change regularly 

We aim to update our site regularly and may change the content at any time. If the need arises, we may suspend access to our site, or close them indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material. 

VII. Our liability 

The material displayed on our sites is provided without any guarantees, conditions, or warranties as to its accuracy. 

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors and for fraud or fraudulent misrepresentation. 

We exclude all implied conditions, warranties, representations, or other terms that may apply to our site or any content on it. 

 

We will not be liable to you for any loss or damage, whether in contract, tort or delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: 

  • use of, or inability to use, our site; or 
  • use of or reliance on any content displayed on our site. 

  

In particular, we will not be liable for: 

  • loss of profits, sales, business, or revenue; 
  • business interruption; 
  • loss of anticipated savings; 
  • loss of business opportunity, goodwill, or reputation; or 
  • any indirect or consequential loss or damage. 

VIII. Prohibited uses 

You may use our site only for lawful purposes. You may not use our site:

  • In any way that breaches any applicable local, national, or international law or regulation; 
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect; 
  • For the purpose of harming or attempting to harm minors in any way; 
  • To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam); or 
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware. 

 

You also agree: 

  • Not to reproduce, duplicate, copy, or re-sell any part of our site 
  • Not to access without authority, interfere with, damage, or disrupt: 
    1. any part of our site; 
    2. any equipment or network on which our sites are stored; 
    3. any software used in the provision of our site; 
    4. any equipment or network or software owned or used by any third party; or 
    5. that each Mini-Course may only be used by a single person and must not be used by groups of people collectively. 

IX. Uploading material to our sites

Any material or information you upload to our site will be considered non-confidential and non-proprietary, and we have the right to distribute and disclose to third parties any such material for any purpose. 

 

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site. 

 

We have the right to remove any material or posting you make on our site if, in our opinion, such material does not comply with the content standards set out in these terms of use and in any acceptable use policy that we may publish on our site from time to time. 

X. Viruses, hacking, and other offenses 

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs, or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which our sites are stored or any server, computer, or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. 

 

By breaching this provision, you would commit a criminal offense under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately. 

 

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of our site or to your downloading of any material posted on them, or on any website linked to them. 

XI. Linking to our sites 

You may link to our home pages, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. 

You must not establish a link from any website that is not owned by you. 

Our site must not be framed on any other site, nor may you create a link to any part of our sites other than the home page. We reserve the right to withdraw linking permission without notice.

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.
